The Council of the Law Society have just passed regulations the effect of which is that from January 1st 2013, a Solicitor will no longer be able to act for both sides in Conveyancing transactions including voluntary transfers (ie where no money is involved and property is gifted).
This means for example that the family Solicitor will no longer be able to represent parents and their son/daughter where the family farm or any part of it is being transferred. What will happen in the future is that the Transferors (the parents) will have to be separately independently advised by another Solicitor of their choice in relation to the transaction and the effects of it. The thinking behind this development is to protect elderly people who may be vulnerable.
